Truth in Sentencing

Truth-in-sentencing debate Learning Team B CJA/204 November 26, 2012 Deana Bohenek Truth-In-Sentencing Debate Opening Argument Truth-in-sentencing laws do not deter crime. The federal truth-in-sentencing law guarantees that certain violent offenders will serve at least 85% of their sentence  (Schmalleger, 2012). However, if the offender acts accordingly in prison, he or she can attain parole for good behavior. What about the victims? Victims do not want to hear this. If an offender is sentenced for 30 years, the victim wants justice and wants to see the full 30 years served.They do not want to see the offender getting released after 25 years. The truth-in-sentencing laws are the judges’ guideline when choosing the sentence of the offender. The law is a structured guideline for sentencing the offenders. However, the judge can deviate from the guidelines if there are mitigating and aggravating circumstances. Look at plea bargaining,  this is still a possibility even though t here are truth-in-sentencing laws in place. The offender knows that if they get caught, they can plea bargain for a lesser sentence and be back out on the streets sooner.Let me say it again, truth-in-sentencing laws do not deter crime. The offenders know they will get out of prison soon through a plea bargain or parole. They know they can avoid serving the full sentence that the judge imposed on him or her. The only way to deter crime and reduce recidivism is to abolish the possibility of parole and ensure that the sentence the judge renders is carried out to full-term. Obviously, to take away the option for parole would mean that the prison populations would increase. Well, we should take the funds left over from overhead to run the parole division and build more prisons to house these offenders.The longer we keep them off the streets, the safer society will be. Rebuttal Argument Each state has to look at the amount of money being spent to house each inmate they have in custody. Be cause the Truth-In Sentencing Law wants to keep the offender behind bars until they complete their entire sentence/term in prison no matter what the costs are to the public. Meaning, everyone’s hard earned income  (taxes) are used to keep them in their present place of occupancy. This law depletes the services we receive from our state revenues.We don’t have much say in the budget spending but we do see the increase in taxes used for each state program. I have to disagree with the statement made â€Å"The offenders know they will get out of prison sooner through a plea bargain or parole. †Ã‚   Not all offenders before or during their trial will know the outcome of sentencing. Many do not have the option for plea bargaining because plea bargaining depends on the severity of the crime committed. Instead, if the case went directly to trial, (this includes judge and jury) the accused might have a chance of plea bargaining.No plea bargaining makes the offender elig ible for a parole based on his or her behavior during incarceration and no plea bargaining being offered. But if society had no parole system, then the correctional system will have to face overcrowding in the institutions. The lack of Rehabilitation for said prisoner would be non-effective because there would be no programs such as work-time credit or good-time credit, which is the main reason why early release would benefit them. With those programs the time served by offenders would be less and would allow the offenders to enter back into society.The fear of re-entry of said offenders are the defense for keeping them locked up. These programs should be used for offenders that have this as a first offense on their record and have shown they can be productive in today’s society. Not all inmates are repeat offenders some are just non-violent offenses but carry a great penalty. When I was younger it was a big deal to go to jail because it showed most people that they were a â €Å"badass†, a badge of honor, and should be feared. In my eyes it was a waste of mind, body, and productive individual. Those same individuals found when they came out ithout a trade they were worthless and the only way to survive was crime and more time in jail. In Illinois, Governor Pat Quinn on October 2, 2012 has reinstated the program for â€Å"Good-time† releases,  a way to bring down the overcrowding in his state and federal prison system. Opening Argument Truth-in-Sentencing laws deter crime because they ensure that offenders are in prison for at least 85% of their sentence. Therefore, the convicted offenders stay in prison for longer periods and not able to commit additional crimes and endanger the member of society.TIS laws are the assurance of longer prison terms as punishment and serve as an effective deterrent from criminal actions to the serving offender and others who may be considering criminal acts. The laws provide the ability for the criminal just ice system to operate more effectively by lowering violent crimes as well punishing violent criminals. According  to the publication from  University  of Alabama at Birmingham (2005) citing data from Bureau of Justice Statistics, in the decade following the passage and implementation of the truth-in-sentencing laws in 1994, the arrests for violent crimes were reduced by 16% by the year of 2005.The TIS laws also limit some of the discretion of the judges and parole boards with regard to release of the offenders prematurely and being â€Å"too soft† on crime, thus eliminating the many possibilities for the offenders getting away without receiving the well-deserved punishment. The Bureau of Justice Statistics Special Report from January 1999 indicates that prior to the TIS laws violent offenders barely served half the length of their sentences. What kind of message did that send to the convicted or potential criminals?With the availability of TIS laws, criminal justice adm inistrators can build public confidence by ensuring that the just punishment is served to anyone breaking the law. In the article written by Joanna Shepherd published in the Journal of Law and Economics, she makes this statement: â€Å"Using a country-level data set, empirical results confirm that TIS laws deter violent offenders, increase the probability of arrest, and increase maximum imposed prison sentences. TIS laws decrease murders by 16%, aggravated assaults by 12%, robberies by 24%, rapes by 12%, and larcenies by 3%† (Shepherd,  2002,  p. 09). Today, more states are implementing the TIS laws and abolishing parole and indeterminate sentencing, demonstrating that the state legislature believes in this uniform application of justice processes and effectiveness of these laws in crime prevention. This information clearly shows that TIS laws are very effective in deterring crime by ensuring the stern and just punishment for offenders and sending the clear message to pot ential criminals that criminal behavior will be punished by lengthy imprisonment. Rebuttal ArgumentWhat about crime being committed in prisons around the world? Are we just going to ignore that fact because victimization is still happening across the boards of federal and state prisons? According to  a writer of The  New Yorker, Adam Gopnik, darkly described America prisons as â€Å"the moral scandal of America life. Prison rape is so endemic- more than seventy thousand prisoners are raped each year. † That is routinely held out as a threat, part of punishment to be expected. † (Gopnik, 2012). The National inmate survey reported that â€Å"An estimated 4. 4% of prison inmates and 3. % of jail inmates reported experiencing one or more incidents of victimization by another inmate or facility staff since admission to the facility  (Beck & Harrison, 2010). The total federal and state population in 2010 was 1,605,127, while the total jail population in 2009 was 767,62 0. This implies that there were over 94,000 victims subject to multiple violations (Beck & Harrison, 2010). No I don't agree with the fact that offenders being incapacitated for longer periods of time don't commit another crime. For people who want to do so, they will commit crimes anyway, and largely at that.Especially, the incentive behind good time credit is to have offenders behave in prison. If you lock them up in less than ideal conditions with no incentive to behave appropriately while incarcerated, they will be a population difficulty to control because they have nothing to lose. Earning good time credit gives them an insight to behave well inside. As for truth-in sentencing laws, I don't know if I  would actually say it is a deterrent or at least how much of a deterrent it  is, but I think it is  important nonetheless. Prior to 2003, legislation allowed for automatic emission of every sentence imposed to be reduced by one third (Chong, 2008). If the offender was made eligible for parole, a portion of that sentence is served under supervision in the community to enable their reintegration  into the community when released (Chong, 2008). Legislation introduced in 2003 abolished the automatic remission provision, so the sentence  imposed would more truly reflect the time to be served. In its place, legislation required courts to adjust the sentence actually imposed by one third, to reflect the abolition of automatic remission (Chong, 2008).What the government has done is  replace  automatic remission with reduction of sentence (Chong, 2008). The more things change, the more they remain the same. Sentences are more or less duration  for the same type of offenses (Chong, 2008). Some say the money being used for these criminals sitting in  jail should be more valuable of utilizing for work  time credits and more programs  for educational, substance abuse, psychiatric help programs for these offenders before being released out into the world again.I think it will better prepare themselves rather than not knowing what to do and all they are use to is the  jail's way of life in which they will end up back  in having that kind of mind set. Similarities in the Epic of Gilgamesh and Siddhartha as Portrayed by an Unknown Author and Herman Hesse

Similarities in The_ Epic of Gilgamesh_ and Siddhartha As portrayed by an unknown author and Herman Hesse Both Siddhartha and Gilgamesh believe in themselves, they do not let others define them or make decisions for them. Siddhartha demonstrates that he has strong will from the very beginning of the novel. He is taught by the Samana even though the teachings he received up to this point in his life say that the Samana’s wayis the wrong religion. â€Å"It is not fitting for a Brahmin to speak angry and violent words/But indignation moves my heart/I do not wish to hear that request a second time from your lips†(Hesse, 9). Siddhartha wants to make his own decision to study with the Samana, therefore, he needed to go against his father’s judgment and demand leave to travel with the Samana. This clearly shows Siddhartha’s strong will by wanting to study with the Samana strongly enough to disobey his father. Siddhartha also demonstrates determination when he does not fall prey to the temptations of Sublime ones teachings. Siddhartha believes you do not need a teacher or scriptures to be taught how to achieve Nirvana. He abandons the Buddha and also his friend with hope of finding the way to Nirvana on his own. Gilgamesh on the other hand is the ruler of Uruk. In order to be able to keep his people alive he needs to be level headed and strong willed. Gilgamesh is so strong willed he seems arrogant, he believes he is one of the Gods and immortal and forgets that he is only 2/3 God. The villagers of Uruk say that â€Å"[Gilgamesh’s] arrogance has no bounds by night or day†(tablet 1, 62). Although his strong will is mistaken for arrogance on numerous occasions, Gilgamesh changes through the course of the novel. After meeting Enkidu he seems less arrogant to the people of Uruk and becomes their hero. Gilgamesh’s strong will helps him through the trials he must face to reach immortality. He faces the battle with Hambaba, the death of his friend, he passes through the mountain pass, rows across the waters of death and then return to his people. Gilgamesh did not give up during his journey because he did not want to let the people of Uruk suffer an illfate. The thought of his people gives him courage and his strong will is what allows him to continue. Gilgamesh and Siddhartha are two men from different times but they still share the same quality of being strong willed. The importance of loyalty is conveyed through Siddhartha’s and Gilgamesh’sloyalty to their friends. Siddhartha is loyal to every person he meets during his journey, but his most trusted friend is Govinda. They start their journey together; Govinda is in love with Siddhartha and therefore follows all his wishes. After meeting the Sublime One Siddhartha feels as though he has wronged his friend by bringing him along on his journey, because they have not found Nirvana: Govinda, my friend, now you have taken this step, now you have chosen this path. Always, oh Govinda, you've been my friend, you've always walked one step behind me. Often I have thought: Won't Govinda for once also take a step by himself, without me, out of his own soul? Behold, now you've turned into a man and are choosing your path for yourself. I wish that you would go it up to its end, oh my friend, that you shall find salvation! Siddhartha wants only the best for his friend so he waits for Govinda to decide to leave him instead of sending him away. Siddhartha wishes Govinda well, even though he knows later on he will feel lonely without his friend. Siddhartha and Govinda meet each other after they depart on two other occasions. On each meeting they speak as though they had never left one another’s side. Friendship thus plays a key role in Siddhartha as well. Gilgamesh initially does not seem like a loyal person because of his arrogance, however, when he meets Enkidu, Gilgamesh becomes a loyal friend. At the beginning of their relationship, Gilgamesh’s loyalty seems questionable, but after the death of Enkidu the reader can see the great love he has for his friend. â€Å"[. . . ] seven days and seven nights he wept for Enkidu† (Tablet, 96). Following the death of his friend, despite Gilgamesh’s vow to walk with him in the neverlands (valley of death), he leaves on a journey to find immortality because he does not want his people to suffer the way he has. Despite his journey to find immortality Gilgamesh comes to realize that immortality will not bring his friend back from the dead. He discovers that he must live his life the way Enkidu would have wanted him to; without grief. Gilgamesh decides to stay loyal to his friend and walk in the neverlands with him after his own death. Gilgamesh and Siddhartha are loyal to their closest friends and they only wish the best for them. Through their loss they were able to achieve impossibilities. Siddhartha and Gilgamesh never truly experience grief until the death of the ones they love. Their experience with grief is similar because it helps them evolve as people and it changes their lives. After the death of Kamala, Siddhartha is enlightened and is able to experience the grief of this world as well as see the grief he inflicts on his father the day he leaves. Kamala’s death leaves Siddhartha with the responsibility of raising his son, who hates living as a ferryman. His son wants to return to the town but his father does not let him. â€Å"I hate you you’re not my father/even if you were her lover ten times over. † (Hesse,108). Siddhartha feels grief at that moment for not being loved by his son, but it is through grief that he can understand Nirvana. Gilgamesh has everything he has ever wanted and he has never had an occasion to understand or feel grief. He would have never felt grief if he did not enjoy the company of Enkidu. The death of Enkidu is the turning point in The Epic of Gilgamesh, because Gilgamesh, in order to forget his grief, sets out on his journey to find immortality, in his attempt to resurrect Enkidu, also to shelter his people from grief. For Gilgamesh and Siddhartha, grief is the turning point in their lives, because it helps them move forward. Siddhartha discovers Nirvana and Gilgamesh finds that you can’t escape reality with immortality. While writing Siddhartha and The_ Epic of _Gilgamesh the authors would have been influenced by the beliefs of the society in which they lived. Siddhartha follows the Buddhist belief that you can find Nirvana through teachings and meditation. Nirvana is a state of mind which is completely at peace and with complete clarity and lucidity without thoughts of volitional formation (Bhikkhu Bodhi). Herman Hesse wrote the novel Siddhartha during his time in India and China, where the central religion is Buddhism. It is unknown to this day who the author of The Epic of Gilgamesh really was. First the story was found on tablets years after it was written and secondly the tablets state that Gilgamesh himself had written the novel. The reason people do not believe it was Gilgamesh who wrote this novel is because it is written in the third person. But we do know that The Epic of Gilgamesh is influenced by the Babylonian’s beliefs of dream interpretation and the cosmic. Since the epic is found in Babylonian ruins, archeologists assume that the epic is written by the Babylonian’s who also believed in astrology. The novel states that it is written during the age of the Taurus, also Gilgamesh sacrifices a bull, which is a custom among the Babylonians (Tony Crisp). Both novels are influenced by the place they were written but also during the era they are written in. Siddhartha is written in 1922 by a German named Herman Hesse who studied the Buddhist religion during 1910-1922. Around the time that Hesse wrote Siddhartha, his wife was suffering from mental instabilities and his son was seriously ill. Hesse stayed positive and strived for spiritual self-realization. Hesse states that â€Å"There is no reality except the one contained within us†(Hesse, 1919), this is a concept found within the novel Siddhartha. The difficulties and trials Hesse has to face helped make his novel one that’s praised around the world. The Epic of Gilgamesh has no official author because it is written on stone tablets that were discovered in the mid nineteenth century by Austen Henry Layard. They believed the tablets to be written around 2000 BCE but the actualdate is still argued. The tablets were found in ancient Mesopotamia, where they discovered 12 incomplete tablets. More tablets with a Syrian script have been found as far away from Mesopotamia as Syria and Turkey. Richard Hines) Both novels were written as a work of fiction but in reality they are both written using the name of an actual historical figure. Siddhartha of Gautama is known as the â€Å"Awakened one† or the Buddha throughout Asia; Hesse’s story does not follow closely to that of the Buddha. The journey they follow is different but the path they take to find Nirvana is the same. They both end up finding Niravan through medi tation and self teachings. the tablets on which The Epic of Gilgamesh is written tell the true tale of the historical figure, Gilgamesh, fifth king of Uruk. Water is the sign of purity and rebirth, but in order to be reborn in water you must emerge from its’ depths. (Didier Coiffard) During Siddhartha’s attempt to escape his life as a merchant, he runs away and decides to commit suicide near a river bank. While under the water he sees the word OM in front of him and finds himself unable to commit suicide. He emerges from the water a renewed man with renewed knowledge. â€Å"The new Siddhartha felt a deep love for this flowing water and decided that he would not leave it again so quickly† (Hesse, 81). He then meets the ferryman and becomes his apprentice in order to study the water and relearn his skills as a Brahmin and Samana. Siddhartha learns to listen to the river and becomes friends with it. With the help of the ferryman and the river Siddhartha finds Nirvana. He also relearns his skills of fasting, thinking and waiting. It is with the help of the river that Siddhartha is able to become a renewed and awakened person. Gilgamesh was also fortunate enough to find rebirth near water. Gilgamesh ends his initial quest near the river of death and retrieves a magic plant. In order to reach the plant Gilgamesh needs to submerge himself in the river. Once he emerges from the water he finds new hope in the magic plant, knowing that he could help his city. On his way back to UrukGilgamesh falls asleep and a snake steals the magic plant. For whom have I labored? For whom have I journeyed? For whom have I suffered? I have gained absolutely nothing for myself, I have only profited the snake, the ground lion! Gilgamesh goes back to Uruk to be with his wife and children, he realizes that he is only human and will keep his promise with Enkidu and walk in the neverlands with him. Both Siddhartha and Gilgamesh follow higher powers during their lives. Buddhists do not believe in a high power so Siddhartha follows the idea of spiritual awakening and a spiritual leader within himself . Siddhartha hears from his spiritual being when he leaves the Buddha and meets a woman that he desires but â€Å"[. . . ] upon hearing his innermost voice, and the voice said, no† (Hesse, 47) He immediately gives up on the woman and leaves her. He hears from his guide more than once through his journey. He hears the voice at the river and sees the word OM which is what gives him emotionalstrength. Like Siddhartha, Gilgamesh also follows a spiritual guide except for Gilgamesh believes in the gods. Until having met Enkidu, Gilgamesh has given his respect to the gods by sacrificing women and animals as well as building temples and shrines. After meeting Enkidu, he takes his fate into his own hands and kills Hambaba, but Enkidu dies by the will of the gods because he was not suppose to kill Humbaba. Gilgamesh has been touched by the gods since birth as his father, Utnapishtim is a god, which would make him 2/3 God and 1/3 man. The lives of Siddhartha and Gilgamesh are touched by a spiritual presence that helps them through their journey to find the meaning of life. In the beginning Siddhartha and Gilgamesh do not understand the meaning of life because they have never experienced anything outside of their cities. Siddhartha does not understand all aspects of life and therefore cannot experience nirvana. So his spiritual voice sends him on a journey to find and experience life. Through his journey he finds that there is no such thing as time, â€Å"Nothing was, nothing will be, everything has reality and presence† (Hesse, 87). Without his journey into life he would have never found this wisdom and with knowing and understanding that time is irrelevant, he would have never found Nirvana. Gilgamesh is much like Siddhartha because he has not experienced anything outside of Uruk. After the death of Enkidu he realizes that he is not immortal and will die one day. This realization scares Gilgamesh so he sets out on his journey to find immortality. After meeting his father, Gilgamesh realizes that becoming immortal is impossible, so Gilgamesh acknowledges that one day he will die because he is only human. With this knowledge he goes back to Uruk and strives to be a good king for the rest of his life. Siddhartha learns that only through life experiences can the spiritual self be understood and Gilgamesh learns that even though one day everything will die, you have to do what youcan at the present time. Herman Hesse and the Babylonian text are stories that will always be loved by many readers. They are stories that can be passed down to future generations and taught for years to come because they show the true meaning of existence. Gilgamesh learns to appreciate his life as a human being as opposed to a god, and not wish for immortality. He also finds that he is only capable of so much. Siddhartha learns that life is meant to be experienced in order to find nirvana and be at complete peace. The stories tell the reader that they do not have to be perfect or have everything to be truly happy with the life they have. Siddhartha and Gilgamesh are two fictional characters very similar in nature, despite having been written in two different times; ancient history and the twentieth century. The morals and ideas that these books hold true to this day, in order to find our spiritual selves we need to go on a journey to the depths of our souls and find the peace with us. In this case, the issue of privacy is unequivocally relevant since those who had brought it forward wanted women to be able to have abortions on the strength of their own convictions, without being forced to consult their spouses of parents. Prior to the ruling, a married woman could not have simply had an abortion without her husband’s concept. Yet the fetus was in her and any health implications would be on her besides, a pregnancy will interfere with the woman’s life more than the man’s (Lloyd, 2011). Furthermore, the child might not be the husbands hence the need for an abortion. The disclosure would have traumatized the woman, and she may have carried the pregnancy to term rather than own up. The same case applied to minors having to seek permission from their parents. This amounts to an invasion of their privacy since if a girl has problems communicating with her parents, she may end up keeping the pregnancy until it was too late out of fear. Had I been a j udge in the trial, I would have struck down all the five requirements because abortion is allowed; there is no reason for it to be made harder for women than it has to be.

Mary Logan author review Essay Mama takes time to explain the prejudices that underlie racist attitudes saying you have to accept the fact that in the world outside this house, things are not always as we would have them to be. Mama explains prejudice used and also explains in a gentle but effective way to Cassie that everybody born on this earth is somebody and nobody, no matter what colour, is better than anybody else. Mama also gives Cassie a lesson about the past, illuminating the familys past and their struggles. She is a caring mother who brings her children up right in the hope that they do not be influenced by the prejudice from whites but to accept everyone equally. In some ways this could be Mary Logans own little contribution to the improvement of the world in the future. Although she is strict with her children, disciplining them when they are disobedient she listens when they have troubles. Usually Mamas beatings consisted of a whipping from her belt but the punishment for Staceys fight and the visit to the Wallace store seemed lenient to the children. At first they were scolded but the children didnt consider that a punishment, and we doubted Mama did either. The real punishment Mama placed upon them was a lesson. She took them up to see Sam Berry and the punishment given to him from whites for disobeying. To me this is a good punishment because not always does a beating make you learn from your mistakes. This however remained in the childrens mind and they did not enter the Wallace store again. The children accept her punishments because they love and respect her. She shows her firmness and strength also when we see her splitting the children up when they are giggling, whipping Stacey and standing by her principles when Harland Granger visits the school. Another characteristic of Mary Logans personality is her cautiousness. For much of the time Papa is away working so therefore Mama is responsible and is the provider for the family. We see her cautiousness at times of increased anger when Papa or Uncle Hammer threatens to confront Mr. Simms or the mob. In both cases Mama tries to prevent them from using violence, it is clear that she prefers to settle things out through non-violent means such as the boycott. Mama fears for the lives of David and Hammer when they reach for the shotgun because she knows the power of the white people is stronger than that of the black man. Another incident where Mama is weary of their actions is when, on their way home, Hammer drives through the bridge where it can only handle one car at a time. Blacks often have to back down for whites to cross it first. Hammer meets the Wallaces and drives on. Mama says that theyll have to pay for that later. Again there is a reminder of the fact that Mama prefers not to use violent mean to settle a conflict when, driving past the Wallace store Hammer makes the comment that he would like to burn the place down. Mama quickly replies saying there are other ways. We are aware that Mama was loved as a child as we hear from Papa referring to Mamas father that every penny hed get his hands on hed put it aside for her schooling This again gives us an idea as to where Mamas kindness and deep need to provide come from. Mamas an educated woman as she learned in a teacher training school and has been employed in the local school for fourteen years. We are also made aware of her education, as her spoken English, like the prose of the novel, is perfect and relatively free from colloquial Americanisms unlike the rest of the Logan family members. We hear from Cassies description that Mama is a beautiful woman. With a slender body and smell of sunshine and soap Cassie feels her Mother is pretty. Mary Logan makes the best of what she has. She uses cardboard lining to disguise the worn out shoes, which Cassie felt uncomfortable for Mama. She cares for the family very much so and has dinner ready when any are hungry, she uses half the ingredients so she will have enough for the next time, this shows Mama plans things out and genuinely cares. The points above all describe how Mary Logan is a strict but loving and understanding parent, a Brave, noble citizen and courageous teacher. I admire greatly how she gives up so much to offer a small part of pleasure to the lives of her children. In many ways Mama is unflawed, proving right in many circumstances and standing up for what she believes in. This woman is an inspiration to all blacks, mothers or people who find it hard to be recognized or respected. I feel she has done her best to bring up children who may be different and change the future, to accept people not by their skin colour or religion but by the content of their character. The box contains many electronic components that process information, the central processing units (CPU) is one of the main components. The microprocessor or the CPU acts as the brain of the computer; another part is the random access memory (RAM). It stores information that the CPU used when the computer is on. RAM information deletes as soon as the computer switched off. On the back of the system unit there are cables plug into a specific ports. Peripheral device or device (hardware) is not part of the system unit. Mouse is use to show and select items on the computer screen. The first mouse looks a bit like a real mouse nowadays we have different shapes of mice. It is connected to the system unit by a long wire however since there are many technological improvements now we have wireless mice. The mouse usually contains a primary buttons, a wheel and a secondary buttons. The wheel allows the user to scroll through the screens for information. The pointer may change its appearance depending where it is situate on the screen. Primary button selects items on the screen by simply clicking on it. It is the principal way to interact with the computer. Keyboard The main use of the keyboard is to type text into the computer, it contains letters and numerical keys. The keyboard also has some special keys such as the function keys which is use to perform different functions relied on where they are use. Numeric keypad authorises the user to enter numbers in a quicker way. The navigation keys perform almost the same task as the mouse as it allows you to move your position within a document or webpage. Monitor A monitor shows a see able form of the information text and graphics on the computer screen. It is like a television as it displays still and moving pictured. There are two types of monitors, the cathode ray tube (CRT) and the liquid crystal display (LCD). They are both design to make sharp images. The only differences between the two monitors are: the cathode ray tube is enabling you to afford it as it is cheaper and the liquid crystal is thinner and lighter. Speakers Speakers are use to hear the sound effects from the computers and listen to music. It is either built in the system unit or connected to the computer using cables. It is software that acts like the core of computer system. The basic functions of the operating system is the drivers and the security concerns. Drivers are programs to enable the operation of the devices specially the one installed on the system (mouse, keyboard, printer, etc). It translates the commands from operating system and also translates it back from the component to the operating system. The operating system also performs other functions such as debug errors and maintains the system. As computer software is a human creation. It makes the operating system lie down to errors so there are security concerns. Programmers sometime make mistakes that are often implement after testing while other software developers provide more efficient one. It means that some of the operating system is more prone to errors while the other software is more secure. Sometimes bugs in software may prohibit the system to communicate with the hardware devices. The instabilities of the software may result to crashes, which consist of freezing and unresponsive. This result may vary depending on the operating system. It can also lead to a point where the computer in to be reboot. The software bugs also allows unauthorised user to get to the system since its vulnerabilities enable the attackers to exploit and take complete control of the system. They can install Malware and attack other machines. So programmers provide security patches rather than updating the operating system. Though Mac suffers from relatively very few hacks, security holes Mac OS x does exist, just like in any other operating system. After which the second processor was built 16-bit processor that had a 5 MHz speed. IBM produced a later version of the 8086 processor it was the first personal computer invented. Several technologies were being made during this time where a later version was launch the Intel 486, which has a 32-bits, and with a speed of 16MHz. The concept of multitasking was the developed where the processor was enable to run both real mode and protected mode. The System Management Mode (SMM) were attribute for power saving and computers went from Command line interface (CLI) to Windows, icons, menu and pointing device (WIMP) interaction. In 1993 the Pentium processor (Intel) came out with a speed of 60 MHz which next after was the Pentium II which has a speed of 233MHz, Pentium III has a speed of 450 MHz followed by Pentium 4 with a speed of 1.3 GHz. Intel inaugurated the Pentium M with a lower speed of 900 MHz. It has a power saver since the battery of the laptop last longer. In 2006 Core processor was introduced which has a speed of 1.6 GHz, Core Duo has a virtualisation capability which allow the computer system to perform multitask on the same computer. AMD even being one off the processor manufacturer it was not known until 1991 where they launched the AM386 processor with a speed of 40 MHz (same capability as the Intel 386). In 1999 Athlon Processor the crucial competitor to Pentium III was introduced by the AMD with a speed of 500 MHz. It was the first processor that reached 1 GHz at that time. The Computer processor continues their development to get the fastest processor. From 1975 the number of transistors used on a chip has double every year. Software programmers will create more cores that will allow multi-thread applications to be utilised. Top Down Listening Activities

Top Down Listening Activities Listening skill is a part of learning English language you must practice for improving your listening over time. The teaching listening skill is the most difficult. because the students are acquired every time and lots of practice. It is not learning in my class. What is the best Strategies for learning Listening skills. There are many activities of listening for my students. I try to tell my students you should be more hearer and be able apply Strategies to listening skills such as, watching the news on the television, listening a news on the radio or listening news from an English radio station , talking about the news with a friend ,get a film and listen to speech . It is one way communication I cannot check all understanding. The two way communications are the students focus on a teacher or native speaker. I would like to suggest a teaching Listening Strategies because Listening Strategies are activities that help understand and remember of listening. I help my students develop a listening skill with a Bottom up and Top down strategies. Top-down listening activities Do you ever get your students to predict the content of a listening activity beforehand, maybe using information about the topic or situation, pictures, or key words? If so, you are already helping them to develop their top-down processing skills, by encouraging them to use their knowledge of the topic to help them understand the content. This is an essential skill given that, in a real-life listening situation, even advanced learners are likely to come across some unknown vocabulary. By using their knowledge of context and co-text, they should either be able to guess the meaning of the unknown word, or understand the general idea without getting distracted by it. Other examples of common top-down listening activities include putting a series of pictures or sequence of events in order, listening to conversations and identifying where they take place, reading information about a topic then listening to find whether or not the same points are mentioned, or inferring the relationships between the people involved. Mary Underwood (1989). In my opinion, it is the best way for teaching listening English skills. I teach a Top down listening skills which I produce the following pictures. The topic : so, what are you going to do now? Firstly, I give them a question. Then listening to the dialogues. After that choose the correct sentences. Finally, my students present in the classroom. The Effectiveness: The students have to be able to hear what the other person is saying and easy to understand in the listening because they try just on only the main idea that they want to know from the question I gave. Like, they have the purpose on listening in each topic. Summary, Listening is one is way in communicative so if we listen in the right way is the best way to understanding what we are hearing. Listening teaching is them very important for student so teach them how to listen in the correct method step by step I think it is a good activity for listening because it is a guide for listening. my student like Top-down listening activities. I teach a Top down listening skill with a song. I give the information to guide for the teaching. The teaching listening skill from a song .There are many thinks in the song for example, vocabulary ,tense and a sentence. It is a challenge for my teaching and this one need innovation and creative for my teaching English because it not boring There are four stages for teach of song. The first, the pre listening. I tell my students they dont worry that they understand every word they hare. In the sentence you must understand for some word and I make sure my students know what they are listening for before I start the song. First, I explain they should concentrate only information they need. Next, I give a question to check my student comprehension of the details. Then, I check for any word that my students may not know. Finally, I select a song it isnt a difficult and not a long. While listening. There are three stages. The first , I play the tape of the song wall in your heart for my students in two time. The second, I tell my student take to note about people or place and what is happening in the song and what, when, why, where and how that they hear. The third, I divide my students in pair. Give a fill in the blanks to complete the song and my student listen again check and share their answers. Post listening, I tell my students to write a meaning and to make a list a new vocabulary of the wall in your heart song and compare their answers and discuss what they understood in the song. and practice a song. I open the song again and tell my students to call out stop when they hear the answers. I and my student sing a song WALL IN YOUR HEART together. The Effectiveness. My students have to be able hear what the song ,understand and happiness with a teaching listening skills. Summary, I am very happy for a teaching listening skills from a song. I saw my students happy and like strategies teaching listening skills of the song. Bottom-up listening activities The emphasis in EFL listening materials in recent years has been on developing top-down listening processes. There are good reasons for this given that learners need to be able to listen effectively even when faced with unfamiliar vocabulary or structures. However, if the learner understands very few words from the incoming signal, even knowledge about the context may not be sufficient for her to understand what is happening, and she can easily get lost. Of course, low-level learners may simply not have enough vocabulary or knowledge of the language yet, but most teachers will be familiar with the situation in which higher-level students fail to recognize known words in the stream of fast connected speech. Bottom-up listening activities can help learners to understand enough linguistic elements of what they hear to then be able to use their top-down skills to fill in the gaps. Underwood (1989). In my opinion, it is a one of a good strategies. I would like present a teaching for a bottom-up. Activity I I designed to help a remember the dividing between word an important bottom up a listening skill. I reads out number of a sentences and ark my students to write down how many words from a easy listening. A student asked to compare their answers in pairs before listening again to check. While listening they should write what they hear before remodeling the complete sentences. Some suitable sentences are : I am going to the market. What dose she do? What are you doing. Do you want some milk ? Can you tell me call? It is nice to meet you. May I help you. I paint picture of New York. They watch comedies He doesnt like it. What have you got ? Id better go soon. There isnt any coffee Let s have a party. The Effectiveness. My students have to be able hear what the listening are a sentence , understand and rebuilding a sentences. Summary, I think my students dont like a teaching listening skills from a bottom up strategies. Reflection Q1: How important is listening? My student just want to speak. My students give opinion Suprada said that : Listening is very important for learning language. When you unable listening you cannot success for conversation. Somchai said that : The listening is important in the learning. Q2: My student hate listening to recording. Is there an acceptable alternative such as reading the transcripts to them aloud. When I taught a listening skill. There are many problem to listening from the recording. I asks my students. Nattaveeranuch said that : I want to listen to the music. I like it because everybody enjoy with a song. Suriya said that : I like listen a news and a music from TV. Chanel Poramase said that : I like listen to native speaker. I like talking with AJ. David. I am very happy when he understand me. Q3: When I do a listening activity in class, the students get frustrated if they cant understand every word. How can discourage them from trying to do this? I would like to tell my student dont worry because it is the second language. You can try listen to a news or a music from radio for a few minute everyday. Q4: My students say that they like listening to songs, but I am not sure that this is a good idea. Should I let them, and, if so, is there an effective way of using song? There are many effective of using a song .My student know a new vocabulary and a sentence. Q5: My course book listening texts sound a bit stilted and unnatural. Is there a good reason for this, and is there a viable alternation? There are many alternation for example, Teaching from song , see the sound tact and a listen to native speaker. Q6: My student complain that they can understand recordings is the classroom, but that they have problems understanding real people when they talk to them. How can I help them with this? Active Listening Steps Make eye contact/Follow speaker Look the speaker in the eyes. When the speaker is addressing a large group (e.g., during a lecture or presentation), eye contact will not be possible. In this case, follow the speakers movements.   Summarize what the speaker is saying Summarize every few sentences by stating the main ideas. Take notes, if this is helpful. Make connections Link what you are hearing to what you already know. Ask and answer questions Check your understanding of what youre hearing by asking questions about what you are hearing. If you can answer the questions, you understand the material. If you cant answer the questions, you need to ask the speaker for help.

INTRODUCTION Since 1962 and the beginning of the discount retailer market Wal-Mart has been ahead of the retail game. By 1967 there were 24 Wal-Marts that had grossed 12.6 million dollars. In just 7 years Wal-mart had spread into 9 states. By 1979 Wal-Mart was the fastest store to reach a billion dollars in sales. In 2005 Wal-Mart has 3,800 domestic stores along with 3,800 stores internationally, and had made over 312 billion dollars. As you can see the Wal-Mart empire has grown monumentally. To move into this segment of the market would be tough. The first Target store was also opened in 1962. It was started under the Dayton Hudson Corporation. As you can see the Target corporation has a decorated past as well. Target now has 1,300 stores in 47 states. The store count itself is still a lot less than Wal-mart. For every one Target store, there is three Wal-Marts. To put together a plan of action we must first research many facets of the Wal-Mart corporation such as: Marketing, Products, and Services provided. From these main areas we will be able to put together a plan for immediate implementation. Products/Services/Marketing The first area to be observed is the products that Wal-Mart sells compared to Target. Wal-Mart offers products in the areas of: Apparel, Baby, Books, Electronics, Garden and patio, Gifts and Flowers, Home, Jewelry, Pets, Sports, Toys, Video Games, Automotive, as well as groceries, and cleaning supplies. Along with being the world's largest retailer, Wal-Mart is also the world's largest grocer. A full grocery center has been added to many of the Wal-mart's nation wide. Wal-Mart's most current goal is to become a player in the organic food market. Adding organic foods to... ...nd many not covered by health insurance. On recent visits to both stores I noticed the Target store was cleaner, and the customer service was better than Wal-Mart. Summary After looking at the Business practices, marketing, products, and services of Wal-Mart I no longer have a doubt that we can compete with Wal-Mart, but the new question is do we want to? In order for Target to be a competitor with Wal-Mart, Target would have to lower its store standards, treatment of employees, and target market. Along with these things Target would also have to go against one of its store standards, and start buying products that were made using slave and or child labor. A few ways that Target could improve by imitation would be through increasing its in store services. The recent addition of the clinic in store is a new and innovative idea a step ahead of Wal-Mart.

Being that the closest that I have ever come to gangs or gangs violence is in television of movies, this topic intrigued me. What makes a person want to become part of something that is so violent and dangerous? Why would someone risk everything to put their lives on the line for people that are not even their blood relatives? As I read the material that I found in the library about gangs, I found out a lot about how this children's' though process works. They believe that the gang members are their family; to them it is not seen as the sinister organization of careless violence as it is to us "normal" Americans. To them the gang is their family. Children are joining gangs at younger ages; our current juvenile justice system is no longer adequate for today's hardened young gang members. According to recent studies in demographics the problem is not going away. This problem if ignored is going to lead to the decay of our society. In many of the articles that I read about gang violence they warned of the impending youth crime crisis. Youth violent crime has been rising dramatically for more than a decade. An upward surge in youthful perpetrators of violence is complemented by an unprecedented growth in youth living with little or no adult supervision. According to Merriam Webster (2014), â€Å"Provision is: the act or process of supplying or providing something.† Every company provides a provision or has a mission statement that their company stand by, which shows what services that company, will commit to delivering to their clients. We as professionals and them as businesses have an obligation to deliver direct services effectively to help clients adapt socially and effectively in society. It is the companies’ responsibility to provide clients with the services that sustain a good work or living environment. Companies are dedicated to providing direct support services that will enhance a client’s quality of life, and that is designed to meet the needs of their client. Moreover, it is important that staff build their time to participate in activities with the clients that they are servicing. It is also the responsibility of the company, to make sure their staff is educated and trained in their area of concentration to assist their client. It is important to develop relationships with clients that will allow them to engage in everyday life activities. It is provided that any person that is working with clients to engage in activities with their client. Clients have IEP (Individual Education Plan) programs that should be followed to assure the client is receiving the proper education that is based on their need. It is up to the worker to provide clients with a structured setting which will allow them to see if the client is learning according to their plan or their day. In every event, every aspect is about providing proper service to the client. Furthermore, it’s about creating independence in that client by setting academic and functional goals that are attainable and reachable from a realistic aspect for that client. A professional’s purpose is not to please coworkers but, their purpose is to be an advocate for their client. In the case scenario of the staff member providing services appropriately to  clients, certain information is required in the process of gathering and covering the basic components of quality assurance, which are proper provision of service, client satisfaction with the service and proper documentation. With reasoning, questions have been formulated to help monitor and prevent future fraud and misappropriation of services as it pertains within these guidelines. From the information gathered from the staff at the school, the client, and all that is involved with working with this particular client, the question is, since the goal for the staff member was to develop and maintain a client-centered service and to provide quality service and ensure the client’s satisfaction, should that particular client have had services from our agency because of a communicable disease in which he/she was recently treated for according to the teacher at the school? According to the teacher employed at the school, where the staff member was working with the client stated that this particular staff member was frequently late, was this tardiness professionally and legally documented? As reported by the teacher at the school where the staff member was working with the client, the teacher reports (if legally documented) that the staff member did not engage in their professional interventions towards a certain client about their behavior on a particular day. Were there any witnesses to this behavior and did the staff not intervene in stopping a certain behavior from this client? The reasoning behind these questions is as follows: Although the teacher at the school at which my agencies staff member was working with a particular client, it was not reported or stated about any legal documentation on this worker’s tardiness at this school. Also was there a specific reason for which my staff member did not tailor in her interventions towards a particular client due to their behavior that was reported to me, the director of the agency. It is believed that gathering the correct and adequate information from all parties involved when working with clients especially in the health care profession, helps those involved have a better understanding what kind of frame of mind the particular staff member, the client involved and even the teacher working with both parties, it is important to obtain such information so that there is no misinterpretation in communication, documenting all actions involved, or just documenting the day’s activities so that the agency and the school can  see if the client shows any improvement with working with a particular staff member. This also helps prevent any legal action involving all parties regarding he said/she said, or future fraud towards a certain agency. As it pertains to the accusation that the staff member is not open to feedback, how was the staff member approached about this feedback? Was this communicated in a professional manner? How exactly did the staff member respond to feedback given? Lastly, did the staff member give reasoning for not accepting feedback about services rendered? This line of questioning is important because it approaches the first accusation from all angles. These questions are trying to determine whether or not the staff member is blatantly refusing to accept feedback or if they are accepting feedback and just not implementing it. It is also important to not how the feedback was approached. If the feedback was delivered in a negative or accusatory way it may not have been implemented because the staff member may have a strict treatment plan and be avoiding confrontation with the teacher by just not accepting feedback. This is why it is important to understand the staff member’s reasoning behind not accepting feedback. It determines whether or not this staff member is providing the client with the proper services and that the staff understands what these services are so that there are no misunderstandings. As it pertains to the accusation that the staff member does not tailor their interventions to the client according to his behavior on a specific day, please name one example where the staff member did not tailor their interventions to fit the client’s needs? How was the staff member approached about this incident? Did the staff member give reasoning for continued their planned treatment? Was this incident documented and if so how was it documented? Were the client’s needs met? Was the client unsatisfied with their services provided? This line of questioning is important because it makes sure that the client is receiving the proper services that they need. The staff member’s treatment plan should always be centered on what is best for the client; not what is easier for the staff member. It is also important that a staff member with a strict treatment plan not stray from their original treatment plan if it affects the overall effectiveness of the treatment. This is why it is important to understand the staff member’s reasoning behind not altering their original treatment plan so as to make sure that this decision is not affecting the way that the  client is treated and or receives their services. Another important part of this line of questioning is that if the client’s needs were not met, how was this documented? Having proof that the client’s needs were not met is important in accessing the staff member’s overall effectiveness in their treatment plan. Lastly, it is important to note whether or not the client was satisfied with the services they received so that the staff member can be clearer in the future about the services they provide as to not having any misunderstandings. As it pertains to the accusation that the staff member is frequently late, has this tardiness been properly documented? If not, are there eyewitnesses that can attest to this accusation? Was the staff member approached about this accused tardiness? If so, by who and what where the repercussions of this action? Also, was this action documented and if so how was it documented? This line of questioning is important because it grants validity or not to the accusation that the staff member is constantly tardy. For there to be action taken against this staff member there need to be legal documented proof that this staff member is constantly tardy. If not there is not much that can be done legally about this accusation unless there is some documentation stating that this individual has been reprimanded about this behavior. As it pertains to the accusation that the staff member has created conflict between them and the teacher, how was this situation handled between the two staff members? How did the school handle this situation? Where all have actions are taken to prevent any further conflict member between the two before filing this complaint? Where these actions documented and if so how where they documented? This line of questioning is important because it relates to the validity of the complaint in general. This relates to whether or not this staff member is even in need of review or whether the school just doesn’t want to deal with feuding individuals. It is important that this type of situation be documented every step of the way or it just becomes he said she said battle. It is important to understand how the school handled this situation so that if there are any misunderstandings about the service rendered at the school by the staff member that these issues be resolved so that the main focus is on the clients. In special cases such as with disclosure of pertinent information in regard to communicable diseases, this breach of security poses a huge impact as it pertains to patient confidentiality and services provided.  Although the sharing of information with other healthcare professionals is important in providing effective patient care, if a breach of confidentiality as occurred and shared amongst other unaware of the contents of the patients history, this disclosure witho ut consent can pose a risk based on standard infection control procedures, as well as exposure-prone risks undertaken in primary care. In such circumstances, in order to repair the relationship once a breach of confidentiality has been made, the director must adequately acknowledge and apologize for the mishap. Ensure that the client understands that this is not how business is normally conducted and that HIPPA laws and regulations are taken seriously within the organization. To ensure that this does not happen again, there should be a mandatory training centered on client confidentiality and rules and regulations of HIPPA, and certificate of completions could be provided to the client to ensure that they are aware of your dedication to mend the relationship. “A Rose For Emily” and “The Lottery” Essay

â€Å"A Rose for Emily†, by William Faulkner and â€Å"The Lottery†, by Shirley Jackson are both short stories that deal with conflict from either the community or individually. Faulkner hints us readers the main conflict in â€Å"A Rose for Emily† is not only Emily but other characters in this short story. For â€Å"The Lottery†, Jackson hints the readers the conflict is more on the social side meaning the community or society not only the main characters. But the main comparisons between these two short stories are the characters, and the communities that seem to be stuck in the past. William Faulkner starts the short story off with saying the character Emily, from â€Å"A Rose for Emily†, is dead. Faulkner divides the short story into five parts, and those five parts talk about Emily’s life which is spoken from the town’s perspective. Emily is described as a burden, whose â€Å"old fashioned† and is basically a mean old lady. The first part starts off with Emily not wanting to pay her taxes and the mayor sets up a meeting of the Board of Aldermen to her home. Not only was she showing no manners, she kept saying she had no taxes to pay and tells her servant, â€Å"the Negro† to show the gentlemen out. The short story continues on with mentioning Emily’s father’s death. The town’s people felt sorry for Emily, not only on the fact that he passed away but the fact that her father was a controlling man. Controlling meaning her father didn’t want her to seek men. Emily was in denial for her father’s death, â€Å"She told them her father was not dead. She did that for three days† (151). She couldn’t let her father go because her father was her life and that was the only life she had. The other parts talk about Emily’s sweetheart named Homer Baron. Everyone in town are happy about her having a sweetheart, but it goes downhill once they find out Homer Baron liked young men. Emily ends up buying poison and it wasn’t easy buying since the druggist was curious as to why Emily wanted it for. The townspeople on the other hand assumed it was so she can kill herself since she’s going through a lot. But Emily doesn’t only purchase rat poison; she ends up buying hologram toilet set with H.B written on them. Six months has passed by and Emily hasn’t been seen, till one day when people noticed her weight gain. Towards the end of the story the people noticed the Negro (servant) runs away while Emily is dying. They then open a door and the first thing  the town’s people notice is Homer Baron’s body being decayed. Next to his body was a print of a body that seemed to lay there every night and a piece of Emily’s grey hair. â€Å"The Lottery†, by Shirley Jackson is about a small town that gathered in a square on a summer day, June 27th. When you think of â€Å"Lottery† you probably assume something positive that deals with money. But that’s not true, in this short story â€Å"The Lottery† is a ritual that’s been going on for generations. It has to do with throwing a rock to a person that gets a mark in the middle of the paper, all towns had stopped doing this ritual but this was the only town that continued. The person who’s in charge of this ritual is Mr. Summers along with a helper Mr. Graves who’s the post master. The Lottery starts off with mixing the papers inside a box and calling out the names from a list. Once everyone had picked out the paper and seen if they had got picked, the people in the village noticed Bill Hutchison ended up getting the black dot. Tessie who is the wife, stands up for her husband and say’s it wasn’t a fair pi ck so Mr. Summer gives them another chance. Everyone in the family got to pick a paper out and this time Tessie ends up getting picked. Now since it’s a ritual it was something you had to do, that’s when everyone in the village including Tessie’s family picked up rocks and threw it to her. â€Å"It isn’t fair, it isn’t right.† (192) Tessie constantly is yelling this because she knew this wasn’t right, it wasn’t right to kill an innocent over a ritual. Both these short stories seem to fall in a similar comparison which is conflict between individual and the community. The narrator in â€Å"A Rose for Emily† gives away that Emily is stubborn; she doesn’t care at what anyone says of her. But in this short story it’s not only one conflict, its several conflicts we notice. One was Emily’s father; she didn’t want to let his body go because he was her only life especially since he was controlled. Another conflict was the community and Emily. People that lived in that town would always say rumors, and basically won’t help her they would just sit back and wait. Then we have Emily and Homer Baron, Emily was lonely, and Homer seemed to be the only person that was someone she loved. Even if it didn’t turn out the way she hoped, she knew just having his presence there was enough. So this shows Emily had conflicts with reality, present and past, and being lonely. â€Å"The Lottery†, on the other hand was conflict between community and individuality, for example Tessie and the village she was living in. The whole ritual â€Å"The Lottery† symbolizes any sin or any bad behavior that has been caused to be passed down from generation to generation no matter how cruel it could be. Tessie is against this whole ritual, she finds it not fair because of killing an innocent person. Old Man Warner was also another person who noticed this ritual wasn’t right, he notices the changes throughout all the years he’s been around. He mentions, â€Å"It’s not the way it used to be,† â€Å"People ain’t the way they used to be.† (191). In â€Å"The Lottery† it shows that no matter if the box changes, the ritual will always remain the same, and instead of the town actually stopping this from happening they join. The past and the community seem to be one of the other noticeable conflicts. The reason for why Tessie could’ve also been yelling out â€Å"It isn’t fair† because this ritual has ended everywhere else but continued in this village. The village is still holding onto the ritual that’s been taking hold for so long that they aren’t really thinking of any other consequences. Both of these short stories fall into somewhat of the same conflict. Like Emily, if she wasn’t so focused into the past meaning being â€Å"old fashioned† then she would’ve fit well into the society without feeling lonely. As for Tessie and her village, if they stopped continuing a ritual that was held on for so long then Tessie wouldn’t have been killed.
